By subscribing to our online marketing and related services (the "Service"), you ("User" or "you") agree not to use the Service to send unsolicited email in any form ("Spam"), that you will follow this Anti-Spam Policy (the "Policy"), and that your use of the Service is subject to the terms of this Policy, the ForceMailer Privacy Policy and the Terms of Service..
In addition to complying with the terms of this Policy, Users must comply with all legal requirements for commercial email service providers in the country of residence of the User and its Contacts, and the following, to the extent applicable (each as amended or superseded and in effect): the Directive 2000/31/EC of the European Parliament and Council of 8 June 2000 on certain legal aspects of information society services, in particular. Electronic commerce in the Internal Market ("Directive on Electronic Commerce"), the Directive 2002/58/EC of the European Parliament and Council of 12 July 2002, concerning the processing of personal data and the protection of privacy in the electronic communications sector ("Directive on Privacy and Electronic Communications"), Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the You are exclusively responsible for familiarizing yourself with applicable legal requirements and ensuring full compliance.
Spam, sometimes known as junk mail, refers to unsolicited commercial email messages, particularly (but not exclusively) mass emails. "Unsolicited" indicates that the recipient did not provide verifiable consent for the message to be sent. "Bulk" indicates that the message is sent as part of a larger collection of messages, all of which have substantially identical content. The phrase "spamming" refers to sending, distributing, or delivering unsolicited commercial e-mail correspondence, particularly in large volumes, via electronic methods of communication.
Subscribers can be added to the Service account (the "ForceMailer Account") in several methods. Email addresses can be imported, added via API requests. In such circumstances, the User must obtain their subscriber's permission before processing their data. It is prohibited to send messages to anyone who has not given their agreement to receive such information from the User. We would like to point out that the subscriber's approval cannot be expected or inferred from remarks in other content. Additionally, subscribers have the right to withdraw their permission at any time.
ForceMiailer will send a new subscriber a message confirming their interest in receiving information from the User. Users may request to disable the confirmation for email and web subscriptions.
We recommend “confirmed opt-in” to all Users. This efficiently prevents spam complaints and makes the list much more responsive, as subscribers are receiving information they expect. At the User’s request, we may send the Contact a message to confirm his interest in receiving information from the User. The confirmation email may be customized, so that recipients can easily recognize to which list they subscribe.
We reserve the right to evaluate the list of subscribers imported by the User in terms of its quality, including the presence of required approvals for the transmission of electronic messages, spam traps, and misspellings. The negative outcome of such a verification allows us to reject the imported list. If a larger number of email addresses are imported, we reserve the right to require the User to do a test dispatch to a subset of the email addresses. The User's capacity to import the whole list or send messages to the remaining email addresses in the list will be determined by the outcomes of the test dispatch.
The User must include honest and correct headers and content in their mails. Among other things, the "From", "To", "Reply-To", and routing information (including the originating domain name and email address) must be correct and clearly identify the sender. The subject line must appropriately reflect the message's content without being false or misleading. The message must also clearly and visibly indicate when it is primarily an advertisement, and it cannot contain any content that is vulgar, offensive, illegal, or otherwise forbidden by relevant law or ForceMiailer policy.
The User must submit ForceMiailer with a genuine physical postal address, which will appear in the message footer. The User is responsible for maintaining and quickly updating this data with ForceMailer to ensure it is current, comprehensive, and accurate..
Each communication sent from the Account must include an unsubscribe link. The link automatically changes the mailing list, ensuring that a Subscriber who has opted out will not receive any future mailings from that Account. Users are expressly prohibited from removing, altering, or hiding the unsubscribe link, charging any fee, requiring any personally identifying information other than an email address, or requiring the Contact to take any action other than sending a reply email or visiting a single page in order to honor an opt-out request.
Once a Contact has opted out, the User is not permitted to send them any additional messages or sell or transfer their email addresses, even in the form of a mailing list. ForceMiailer automatically processes any unsubscribe requests on the user's behalf and displays a list of Contacts who have opted out in the account.
The User must not use the Service to send spam. Emails using the ForceMiailer.com domain and the ForceMiailer URL cannot be included in a bulk message or a bulk-advertised web page.
We reserve the right to give a warning or take other action if the User is discovered spamming or using the Service for any abusive, illegal, banned under ForceMiailer Terms of Service, or otherwise unauthorized purposes. In each such event, ForceMiailer reserves the right to take any action it deems appropriate under the circumstances, including, but not limited to, warning, canceling the User's Account without notice or refund, and/or reporting the User and the incident to their ISP and the applicable authorities. The User shall be accountable for any loss or damage experienced by ForceMiailer or a third party as a result of noncompliance with this Anti-Spam Policy.
If you suspect you have received spam, please inform us at abuse@forcemailer.com.
